How to make a successful compensation claim
If you suffer a personal injury or accident that was (at least partly) some one else's fault then you may be able to file a compensation claim. If successful, you may be reimbursed with an amount consistent with the pain and suffering you have experienced, as well as covering any expenses and loss of earnings which have put you out of pocket. This includes any medical bills you have incurred whilst getting treatment.
In order to procure a successful compensation claim the following background work should be undertaken by the individual, including;
- Record the time and date of the accident
- Collect the names and contact details of any witnesses
- Take pictures of the scene/collect any evidence from around the area where the accident took place
- Report the accident to police where necessaryGet copies of any medical records regarding your diagnosis/treatment
Once this material has all been collected, they can be handed over to the solicitor handling your case, who will then do the rest of the work. There is a common misconception amongst the general public that a compensation case can end up taking over your life with stress and worry about whether or not the claim will be successful, and if so how much of the compensation awarded you will actually get in your pocket. The answer is, quite simply, all of it. The lawyer working on your behalf will not only take over all of the preparation, such as chasing up witnesses and going over medical/police reports, but will also then send the bill for their legal fees over to the other party! It is known as a no win, no fee compensation claim, and one which most companies these days are offering. People should always do a bit of research on the company before deciding to go with a certain company, to make sure they are not likely to try and siphon money off you without you realising. Reputable personal injury lawyers will have had years of experience in the type of injury cases you are pursuing, and be able to offer you free consultations and analysis before going ahead with your case. Another tip is to make ask them whether they provide insurance for your case, which won't be a huge amount, but covers you in the event that your claim is unsuccessful. Whilst you would not have to pay your own lawyers fees, as per the no win, no fee agreement, but you will be liable for the costs of the defending party; their legal bills, court costs, and any other fees they have incurred whilst battling your claim for compensation.
During the time you accident lawyer is chasing your claim you should stay in regular contact with them, so that you can are aware of any changes in the progress of the case, and are available to provide any information needed as quickly as possible - the quicker the case is ready to file, the quicker the chances of getting your cheque. Lots of cases are actually settled out of court, especially id your claim is strong, which is another reason to make sure you are aware of how the case is progressing.
