Compensation Calculations
The amount of compensation received varies from case to case, and depends on a number of factors. Obviously, the type of injury suffered will have a big impact on the money paid out, and this varies from body part to body part. Some typically examples are shown below;
- Whiplash Injury: £750 to £2,550
- Back Injury: £4,575 to £58,500
- Brain/Head Injury £1,300 to £165,500
- Deafness: £4,300 to £81,500
- Asbestos-related: £4,000 to £74,000
- Hernia Injury : £2,000 to £14,000
- Spleen Injury: £2,550 to £15,250
- Knee Injury: £8,150 to £56,000
- Ankle Injury: £3,300 to £40,750
However, these are just ballpark figures, and are simply figures for general damages only; other financial implications such as future earnings lost and interest, and special damages may be paid on top of any initial amount agreed which is purely based on the original pain and suffering caused by the injury. It is impossible to gauge an accurate figure for you type of injury until it has been assessed by a qualified solicitor with experience in these matters.
No two accidents are ever identical, which is why trying to judge the amount of compensation you will be rewarded is often a pointless exercise. That said, estimates can be made, judging by the extent of the injury, and the length of time it has taken (or is taking) to recover. Recovery times are different for different people, and some people may not recover fully from accidents that other people overcome quite quickly. The effect these injuries have on your life at the moment and will continue to have in the future will also work to determine the amount of compensation you receive. As well as physical damages, there are emotional effects to consider on top. For example, two individuals involved in similar road traffic accidents may react differently, even if their injuries are also similar. One might be afraid to ever get behind the wheel of a car again, yet the other person may begin to drive again within the same week of the accident, or even the same day. Because of the unpredictable aspect of personal injuries, it is impossible to tell from the outset the amount of compensation you will receive from the case. One point to note here is that the compensation amount will be adversely affected if the client themselves were negligent and had some defining role to play in their own injury.
A plus point for potential clients of personal injury claims companies is that you can guarantee the lawyers will be working as hard as possible on your case to try and generate the maximum amount of compensation they can. This is because the more they can rescue for their existing clients, the more their reputation will be enhanced and this will therefore help to attract new claimants to their company. Plus, the obvious fact that they only get paid in the vent of a positive outcome will always spur lawyers on to do their best in court on your behalf.
