Drunk man who ran into car cannot sue driver
April 27th, 2009
A man who ran into a road and suffered serious head injuries can not sue the driver for negligence the High Court held.
The case hinged on the proposition that the driver who was sober should have been looking out for Mr S who unexpectantly ran into the road.
Mr S had drunk between five and seven pints of beer was sitting at a bus stop talking to a friend.
Rejecting the negligence claim, the Judge said that due to Mr S’s conduct, the collision was all but inevitable.
