Cosmetic Surgery Medical Negligence Claims
Cosmetic surgery is a practise that will always have controversy surrounding it, mainly from the people who disagree with it but whatever your views on it there is no denying that in the past few years cases of people going under the knife have increased and sadly as a result of it so have the number of compensation claims. Compensation claims surrounding cosmetic surgery have risen in the last ten years. The most common reasons that people make a claim following cosmetic surgery include: - A lack of proper informed consent including lack of a full explanation of all risks and alternatives
- Unexpected obtrusive scarring following a face lift
- Less than satisfactory results for dermabrasion, chemical peels and laser surgery particularly to face
- Injury to the accessory nerve following a face lift
- Poor outcomes from rhinoplasty
- Breast uplift resulting in excessive or unexpected scarring
- Breast reduction resulting in unevenness or unexpected and unsightly scarring
- Liposuction resulting in perforation to the bowel or damage to other parts of the body
- Liposuction procedures resulting in unacceptable scarring
Some people, however, have unrealistic expectations of what can be achieved by a cosmetic procedure and what the risks that are involved in a cosmetic procedure, which ultimately results in them being dissatisfied with the results. It is because of aspects such as these that The Care Standards Act was set up. The main aims of The Care Standards Act includes; all practitioners must be appropriately trained, recruited and qualified and that patients should be offered counselling for a two week cooling off period before treatment. Before the introduction of The Care Standards Act, many private clinics employed doctors who had dropped out of specialist training and advertise as being 'Fellows of the Royal College of Surgeons' but this is no guarantee that they have any specialist training. This basically meant that doctors from any medical speciality could perform surgery. The Care Standards Act came into force on the 1st of April 2002, which has improved the standards of cosmetic surgery but sadly mistakes and accidents still occur.
